These terms and conditions (the "Terms and Conditions") govern the use of www.loquatlearning.com (the "Site"). This Site is owned and operated by Loquat Learning. This Site is an educational services website.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Intellectual Property
All content published and made available on our Site is the property of Loquat Learning and the Site's creators. This includes, but is not limited to text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
Tutoring Session Policies
Student Cancellations / No-Shows
Scheduled sessions can be rescheduled or cancelled at least 24 hours before the scheduled start time without any penalties. If a session is cancelled with less than 24 hours' notice, or in the event of a no-show, the full fee for the session may be charged. If you need to reschedule or cancel a session, contact us at least 24 hours before your scheduled session time.
Tutor Cancellations
Tutors may cancel and reschedule lessons up to 24 hours before the scheduled time. If a tutor has to cancel/reschedule with less than 24 hours notice, the lesson fee will be refunded and the lesson will be rescheduled.
Tutor No-Shows
In the unlikely event that a tutor misses a lesson without warning, whether it is online or in-person, the lesson fee will be refunded and the student will be able to reschedule for any time. Additionally, the student will receive a complimentary lesson at their convenience within the same month.
Photography and Image Rights
Loquat Learning reserves the right to take photographs or videos during the course of sessions or activities associated with our services. We will inform both students and parents if we will take photographs or videos before the session commences. The ownership of these photographs and videos remains with Loquat Learning. These may be used in promotional materials, marketing collateral, and digital platforms such as our website and social media channels. Parents or guardians who do not wish for their child's image to be used in this way must inform Loquat Learning in writing.
Protection of Minors
We are committed to the safety and privacy of the children who engage with our services. All users who engage with the Site on behalf of a minor must ensure they have the appropriate parental consents. We reserve the right to take appropriate legal action to protect the welfare of minors when necessary.
Dispute Resolution
Any dispute arising out of the use of our Site or services will first be attempted to be resolved through open dialogue and negotiation. If a resolution cannot be reached, the dispute will be subjected to the laws of Bermuda.
Payment Terms
Payments for our services are due upfront and can be made using methods arranged between you and Loquat Learning before the time of your first session. If you are not satisfied with a tutoring session, please reach out to us within 24 hours of the session ending. Refunds, if any, will be given at the discretion of Loquat Learning management. If we do not receive payment for a completed session, Loquat Learning reserves the right to refuse service until the agreed payment arrives.
Safety and Conduct
All users are expected to behave responsibly and respectfully during tutoring sessions. Any form of harassment, bullying, or inappropriate conduct is strictly prohibited and may result in the termination of services. When online, all users must respect others' privacy and must not share or request personal information.
Privacy
We value your privacy and take the protection of personal data seriously. We collect and store personal data in compliance with applicable privacy laws in Bermuda and use this information solely for the provision and improvement of our services. For more details, please refer to our Privacy Policy.
Limitation of Liability
Loquat Learning and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Loquat Learning and our directors, officers, tutors, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the Bermuda.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Termination of Services
We reserve the right to terminate or suspend services to any user who violates these Terms and Conditions, with or without prior notice and without liability. Furthermore, if a user’s actions put the safety of our tutors, other students, or staff members at risk, we may terminate the user’s access to our services immediately.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
